Terms of Service

Acceptance

By accessing or using Fairvisor (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service. Your continued use of the Service following any changes to these Terms constitutes acceptance of those changes.

Service Description

Fairvisor is an API observability and control plane for AI-powered applications. It consists of two components: (1) an open-source edge proxy, licensed under the Mozilla Public License 2.0 (MPL-2.0), which you deploy on your own infrastructure; and (2) a proprietary SaaS control plane (“Control Plane”) hosted by Fairvisor, which provides dashboards, configuration management, alerting, and billing. These Terms govern your use of the Control Plane and any associated services provided by Fairvisor.

Account Registration

To access the Control Plane, you must register for an account using a valid email address. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must notify Fairvisor immediately at hello@fairvisor.com if you suspect any unauthorised use of your account. Fairvisor reserves the right to refuse registration or cancel accounts at its discretion.

Acceptable Use

You agree not to:

  • Use the Service in violation of any applicable law or regulation;
  • Attempt to gain unauthorised access to the Service or its underlying infrastructure;
  • Reverse engineer, decompile, or disassemble any proprietary component of the Service;
  • Resell, sublicense, or otherwise make the Control Plane available to third parties as a standalone service without Fairvisor’s prior written consent;
  • Use the Service to transmit malicious code, spam, or content that infringes third-party rights;
  • Abuse, overload, or interfere with the integrity or availability of the Service.

Fairvisor reserves the right to investigate suspected violations and to suspend or terminate access without prior notice if necessary to protect the Service or other users.

Intellectual Property

The open-source edge proxy component of Fairvisor is licensed under the Mozilla Public License 2.0 (MPL-2.0). A copy of that licence is available at https://www.mozilla.org/en-US/MPL/2.0/.

The Control Plane, including its source code, user interface, documentation, trademarks, and all associated intellectual property, is the exclusive property of Fairvisor and is protected by applicable intellectual property laws. Nothing in these Terms grants you any rights in the Control Plane beyond the limited right to use the Service as described herein.

Payment Terms

Access to paid tiers of the Service is billed through Stripe. By subscribing to a paid plan, you authorise Fairvisor to charge your payment method on a recurring basis at the then-current subscription rate. Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date.

Refunds are available within 14 days of the start of a new billing period. After 14 days, all charges are final and non-refundable. Fairvisor reserves the right to change pricing with 30 days’ prior notice by email.

Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Fairvisor does not warrant that the Service will be uninterrupted, error-free, or free of harmful components. At this stage of the product, no specific uptime commitments are made unless separately agreed in writing.

Limitation of Liability

To the maximum extent permitted by applicable law, Fairvisor’s total liability to you for any claims arising out of or relating to these Terms or the Service — whether in contract, tort, or otherwise — shall not exceed the total fees paid by you to Fairvisor during the three (3) months immediately preceding the claim. In no event shall Fairvisor be liable for indirect, incidental, consequential, punitive, or special damages, even if advised of the possibility of such damages.

Termination

Fairvisor may suspend or terminate your access to the Service, with or without notice, if you breach these Terms, if your account remains unpaid after the due date, or if Fairvisor ceases to operate the Service. Upon termination, your right to use the Service immediately ceases. Provisions of these Terms that by their nature should survive termination will do so, including Sections on Intellectual Property, Disclaimer of Warranties, Limitation of Liability, and Governing Law.

Changes

Fairvisor may update these Terms from time to time. If changes are material, Fairvisor will notify you by email at least 30 days before the changes take effect. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.

Governing Law

These Terms are governed by the laws of the European Union and the member state in which Fairvisor is incorporated. The specific jurisdiction will be confirmed upon incorporation and this section will be updated accordingly. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts of that jurisdiction.
